Members of the Santa Monica Community College (SMC) community have the right to be free from sexual violence. All members of the campus community are expected to conduct themselves in a manner that does not violate the rights of others.

SMC has zero-tolerance for sexual assault. When an allegation of misconduct is brought to an appropriate administration's attention and a respondent is found to have violated any sexual assault district policy, serious sanctions will be used to reasonably ensure that such actions are never repeated. The following is intended to define community expectations and to establish a mechanism for determining when those expectations have been violated.

All SMC community members have the duty to understand student rights and responsibilities; therefore, it is important that you are familiar with the following laws, policies, and procedures as they relate to gender-based discrimination and sexual misconduct:

Title IX of the 1972 Education Amendments is a powerful tool for combating campus violence. The law states that "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance." The law requires colleges and universities receiving federal funding to combat gender-based violence and harassment, and respond to survivors' needs in order to ensure that all students have equal access to education.

The Title IX office is dedicated to addressing issues of sexual violence or physical abuse to ensure a safe and healthy environment for all members of the college community. Any sexual violence or physical abuse, as defined by California law, whether committed by an employee, student, or member of the public, occurring on college-owned or controlled property, at college-sponsored or supervised functions, or related to or arising from college attendance or activity is a violation of District policies and regulations, and is subject to all applicable punishment, including criminal and/or civil prosecution and employee or student discipline procedures.
